HIGHFIELDS TRAVEL AND CRUISE TERMS AND CONDITIONS
These are important terms and conditions and you should carefully review them before making any booking with our office.
Prices quoted are in Australian Dollars unless otherwise notated. Prices are subject to change at the discretion of the supplier, prior to booking. This is out of the control of Highfields Travel and Cruise. Prices include applicable taxes. Generally, price is only guaranteed once paid in full.
Highfields Travel & Cruise is accredited through the AFTA Travel Accreditation Scheme (ATAS). Our Accreditation Number is A13385. Please refer to www.afta.com.au/atas for further details
FEES AND CHARGES
We may charge a fee for making a booking on your behalf. You acknowledge that we may receive fees, commissions, gifts or financial incentives from third parties under this contract from suppliers for bookings made on your behalf.
You will be required to pay a non-refundable deposit on booking. Some services such as airfares may need to be paid in full at time of booking. Your consultant will advise you of all other payment due dates. These dates must be adhered to in order to secure your booking. Late payment may see your booking cancelled and deposit forfeited and the payment of additional costs to rebook may be necessary.
Changes and cancellation of bookings may incur fees from suppliers. Some tickets and arrangements are non-refundable and non-transferrable. Any refund for cancelled bookings will not be paid until the supplier provides the refund to Highfields Travel and Cruise. Highfields Travel and Cruise will not provide you with a refund for the service fee charged if the booking does not go ahead. Refunds for bookings are subject to the terms and conditions of suppliers. Highfields Travel and Cruise is not responsible for supplier delays in issuing refunds. Note that airlines can take 60 to 90 days to process any refund.
FORMS OF PAYMENT ACCEPTED
Cheques: Cheques will not be accepted within 7 working days of travel or payment due date to allow time for funds to clear. Cheques to be made payable to Highfields Travel and Cruise
Credit Card: We accept Visa, Mastercard and Amex. The transaction will appear as Travelpay on your bank statement. Surcharges will apply when paying by credit card. Credit Card Fees are dependent on the card type and will be between 1% and 2%. We can provide a quote on this prior to payment. SCHEDULE OF FEES
If any ticket has been issued that requires a change, for example a date, a reissue fee will apply, at a fee of $120.00 per change to Highfields Travel and Cruise in addition to any reissue fee payable to the airline.
All cancellations are governed by the terms and conditions of the airlines and suppliers booked for services. After confirmation, all cancellations will incur a flat fee of 12% of the total cost of your trip booking, in addition to any supplier/operator imposed cancellation charges. No refund will be provided for cancellation on or within 30 days of departure. All deposits are non-refundable. Please not that any refund can take between eight and twelve weeks to process from our suppliers.
Late Booking Fee
Bookings made 8-14 days from departure will incur a $100.00 per person fee. Bookings made 7 days from departure will incur a $150.00 per person fee. Late booking fees are charged as we have to reschedule work to get these bookings made and put documentation together as soon as possible. To avoid these fees please complete your bookings at least 2 weeks in advance.
Excessive Time and Itinerary Planning
In the event that you require very complicated or time consuming travel arrangements as deemed by your consultant, provision is made for the charge of $250.00 (non refundable) to be paid by you which will be deducted from your balance should you make a booking.
Insurance Claim Fee
For clients purchasing insurance through Highfields Travel and Cruise there is no fee for assisting with your travel insurance claim. For clients who arrange their travel insurance through other providers, we charge a $150.00 fee to produce supporting documentation required to assist with your claim.
A change fee of $120.00 per change will be charged to your itinerary for any changes made after original deposits have been made. This refers to change of dates, transport methods. This is in addition to any change fees paid by suppliers.
Domestic Flight Booking Fee
An administration fee of $40 per ticket will be charged on all domestic airline tickets when no further land arrangements or insurance policy is purchased.
International Flight Booking Fee
An administration fee of $50 per ticket will be charged on all international airline tickets when no further land arrangements or insurance policy purchased.
**NAMES MUST BE AS PER YOUR PASSPORT**
A valid passport is required to travel internationally. Most countries require the validity to be at least six months beyond the return date to Australia. Please ensure tickets are issued with correct spelling. You can be denied boarding and airlines charge to change spelling of names. If you are travelling on a foreign passport you may require a re-entry visa on return to Australia.
Some countries require visas for entry. It is the passenger’s responsibility to ensure they have the appropriate documentation including visas. We are happy to assist you in determining visa requirements wherever possible.
If you are travelling to the United States you are required to register under the Visa Waiver program at least 72 hours prior to departure. https://esta.cbp.dhs.gov/esta/. Please note, you may not meet the requirements of ESTA and may be required to obtain a visa which requires travelling to Sydney or Melbourne and can take 6 weeks to be approved.
Travel Insurance is strongly recommended by our office and Department of Foreign Affairs. You must obtain a Product Disclosure statement relating to the travel insurance product you are considering purchasing and you should read this document before making any decision about whether to acquire the product. Should you opt to decline travel insurance you may be required to sign a disclaimer.
HEALTH, VACCINATIONS AND GENERAL TRAVEL ADVICE
Please check with your local doctor or specialist vaccination clinic for up to date health requirements. To visit most popular destinations no vaccinations are required. However, for some unique, tropical, or adventure destinations there may be the need for vaccinations. Please check with our office for further details.

CHECK IN TIMES
Please note that the following check in times are recommended:
It is recommended to check in 3 hours prior to departure for international flights
For domestic flights, check in closes 1 hour prior to departure within Australia. Overseas check in can close 2 hours prior to departure. Remember to allow time for airport security screening. All passengers on domestic flights must present ID at check-in i.e.: drivers licence or passport.
Many airlines will refuse boarding to clients who do not arrive at the airport with sufficient time to board and you will be liable for additional costs to be placed on new flights.
Government tax, airport charge, fuel surcharges are current at time of booking but are subject to change without notice. Airport and departure taxes are not included in the airfare, or included within the Government taxes. Additional departure taxes may be applicable at some airports and payable in local currency directly on departure.
FREQUENT FLYERS AND SPECIAL REQUESTS
Please advise your consultant of any frequent flyer numbers and special requests (e.g. meals, seating). It is advisable that you retain all boarding passes until your frequent flyer points have appeared on your statement. Highfields Travel and Cruise has no responsibility for an inability to claim points. Special Requests are at the discretion of the travel supplier.
We act as an agent for, and sell various travel related products as agent on behalf of, numerous transport, accommodation and other service providers, such as airlines, coach, rail and cruise line operators, as well as all of our wholesalers. Any services we provide to you are collateral to that agency relationship. Our obligation to you is to (and you expressly authorize us to) make travel bookings on your behalf and to arrange relevant contracts between you and travel service providers. We exercise care in the selection of reputable service providers, but we are not ourselves a provider of travel services and have no control over, or liability for, the services provided by third parties. All bookings are made on your behalf subject to the terms and conditions, including conditions of carriage and limitations of liability, imposed by these service providers. We can provide you with copies of the relevant service provider terms and conditions on request. Your legal rights in connection with the provision of travel services are against the specific provider and, except to the extent a problem is caused by fault on our part, are not against us. Specifically, if for any reason (excluding fault on our part) any travel service provider is unable to provide the services for which you have contracted, your rights are against that provider and not against us. Note that brochures supplied are not published by Highfields Travel and Cruise and are supplied by the suppliers. Highfields Travel and Cruise accepts no liability for errors in the material.
LIABILITY DISCLAIMER, CANCELLATION IN ERROR AND FORCE MAJEURE
Highfields Travel and Cruise do not endorse or recommend any particular travel service provider, nor do Highfields Travel and Cruise vouch for the accuracy or completeness of information provided by third parties in relation to their products and services. Information is provided in good faith, and is subject to amendment at any time without notice. You should make your own evaluation of the accuracy or completeness of any information, opinion, advice or other content available.
Highfields Travel and Cruise are not liable for any inconvenience caused or expense incurred as a result of any unsuitability or non provision of travel services for use in association with other travel services except to the extent that liability in relation to those matters may be imposed on Highfields Travel and Cruise by legislation that cannot be excluded. Our role in relation to the client’s travel arrangements is limited to facilitating their booking and arranging travel documentation, payments and refunds as applicable.
Highfields Travel and Cruise do not accept any liability of whatever nature, whether in contract, tort or otherwise, for the acts, omissions or default, whether negligent or otherwise, of third party providers over whom Highfields Travel and Cruise have no direct control. In circumstances where liability cannot be excluded, such liability is limited, in each instance, to the value of the purchased travel arrangements.
Highfields Travel and Cruise accept responsibility for the performance and provision of our services and for the negligence of our employees, strictly on the basis that our liability is limited to, in each instance, the value of the purchased travel arrangements. To the maximum extent permitted by law, Highfields Travel and Cruise do not accept liability in contract, tort or otherwise for any technical errors, corruption of any data, unauthorized access to your personal data, inaccuracies in information supplied by third parties, or failure by Highfields Travel and Cruise to complete bookings caused directly or indirectly by force majeure or any other event which is beyond our control which is not preventable by reasonable diligence on our part.
Neither Party will be liable for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, outbreaks of infectious disease or any other public health crisis, civil commotion, breakdown of communication facilities, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy. For the avoidance of doubt, Force Majeure shall not include (a) financial distress nor the inability of either party to make a profit or avoid a financial loss, (b) changes in market prices or conditions, or (c) a party’s financial inability to perform its obligations hereunder. In the event that a force majeure applies, the customer will be bound by the supplier’s terms and conditions and the governing law of Australia and Queensland.
Cancellation due to Error
Despite our reasonable precautions, products may be listed at an incorrect price or with incorrect information due to a typographical error or like oversight. In these circumstances, Highfields Travel and Cruise reserves the right to cancel the transaction, notwithstanding that the client’s credit card has been charged. Highfields Travel and Cruise reserve this right up until the time of delivery of goods to you. If a cancellation of this nature occurs after your credit card has been charged for the purchase, Highfields Travel and Cruise will immediately issue a credit to the client’s credit card account for the amount in question.
JURISDICTION AND LAW
In entering into this agreement with Highfields Travel and Cruise to arrange travel services, all maters arising out of or in connection with it and all terms are governed by the laws applicable in QLD. By accessing our website or booking through our premises, you consent and submit to the non –exclusive jurisdiction of the Courts of QLD in all matters arising out of or in connection with your use of our services and terms.
Vaingrada Pty Ltd as trustee for The Hardie Family Trust (ABN 28 561 786 148) and trading as Highfields Travel and Cruise is a member of The Independent Travel Group, Australia.
(“You” and “Service”). Highfields Travel and Cruise includes its subsidiaries, related body corporates, associated entities and its franchised agents (if any).
“You” means any user of the website www.highfieldstravelandcruise.com.au and includes any person who receives a Service booked through our travel agency (whether or not that Service was acquired by another person);
“Service” means making this site and any software associated with it available to you and providing a facility to enter into transactions with third parties, whose details and products and services appear on this site.
YOUR OBLIGATIONS AND WARRANTIES
In consideration of Highfields Travel and Cruise permitting you to use the Service, you warrant to us that: (a) you are at least 18 years old and have the power and authority to enter into a binding contract with us and with the suppliers of products and services that you acquire; (b) the information you provide us about yourself is true, accurate, current and complete (apart from any optional items) as required by any registration process; and (c) you will maintain and promptly update this information to keep it true, accurate and complete.
You must use the Service in accordance with these terms and conditions and must not use the Service in any way to breach any laws or defame anyone. You agree to indemnify us from and against all claims, actions, suits, demands, liabilities, costs or expenses, losses including consequential losses, whether arising directly or indirectly from the use of the Service by you or any person using the Service through any means provided to you.
ACCEPTANCE OF TERMS AND CONDITIONS
I/we, _________________________________ acknowledge that I/we have read and accept these terms and conditions as outlaid by Highfields Travel and Cruise. I/we acknowledge that once Highfields Travel and Cruise accepts a booking on behalf of a third party travel supplier (supplier), that I/we will have a separate contract with each supplier engaged, which will be governed by the supplier’s terms and conditions. It is my/our responsibility to make ourselves aware of those other Terms and Conditions and agree to be bound by those. I/we are over the age of eighteen (18) and have sufficient funds to pay for the travel services. I/we are responsible for checking the accuracy of all documents provided to us.
